TERMS AND CONDITIONS: Tour In Morocco


These terms and conditions ("Terms") govern the relationship between Tour In Morocco ("we", "us", "our") and you, the customer ("you", "your"), who wish to purchase travel services or products from us. By booking a tour with us, you agree to be bound by these Terms, which form a legally binding contract between you and us. Please read them carefully and contact us if you have any questions.

In these Terms, the following words have the following meanings:

  • "Booking" means the reservation of travel services or products with us, either directly or through a third-party agent or platform.
  • "Tour" means the travel package that includes transportation, accommodation, activities, and other services or products that we offer or arrange for you.
  • "Travel Documents" means the passport, visa, health certificate, insurance policy, and any other document required for your travel.

Eligibility

To book a tour with us, you must be at least 18 years old and have the legal capacity to enter into a contract. You must also ensure that you and anyone traveling with you meet the health and fitness requirements for the tour, as well as the entry and exit requirements of the countries you visit. You are responsible for obtaining and carrying all the necessary travel documents, such as passport, visa, health certificate, and insurance policy. We are not liable for any loss, delay, or denial of service due to your failure to comply with these requirements.

We reserve the right to refuse service to anyone who does not meet these eligibility criteria or who breaches these Terms or any applicable laws or regulations. We may also cancel or terminate your booking or tour at any time, without refund or compensation, if you or anyone traveling with you engages in disruptive, abusive, or unlawful behavior, or if your participation poses a risk or inconvenience to us, our suppliers, or other customers.

Booking and Confirmation

You can book a tour with us either directly through our website, phone, or email, or through a third-party agent or platform. To confirm your booking, you must pay a deposit of 30% of the total amount of the tour, or the full amount if the booking is made within 30 days of the departure date. You must also provide us with your full name, contact details, and any special requests or preferences. We will send you a booking confirmation and an invoice by email, which will include the details of your tour, the balance due, and the payment deadline. Your booking is not final until you receive our confirmation and pay the balance in full.

You may request to change your booking at any time before the departure date, subject to availability and our approval. We may charge you an administration fee and any additional costs incurred by us or our suppliers due to the change. We will notify you of the revised price and terms before confirming the change.

You may cancel your booking at any time before the departure date, by notifying us in writing. We will apply the following cancellation fees, based on the date we receive your notice:

  • More than 30 days before departure: 30% of the total amount (deposit)
  • 15 to 30 days before departure: 50% of the total amount
  • 7 to 14 days before departure: 75% of the total amount
  • Less than 7 days before departure: 100% of the total amount (no refund)

We may also cancel or modify your booking or tour at any time, due to reasons beyond our control, such as weather, natural disasters, civil unrest, war, terrorism, pandemic, or supplier failure. We will inform you as soon as possible and offer you one of the following options:

  • A full refund of the amount paid
  • A credit for a future booking with us, valid for one year
  • A substitute service of equivalent or higher value, subject to availability and your acceptance

We are not responsible for any other costs or losses that you may incur as a result of the cancellation or modification, such as travel insurance, flights, or visas. We recommend that you purchase adequate travel insurance to cover such risks.

Services and Products

We offer or arrange various services and products for your tour, such as transportation, accommodation, activities, and meals. The details of each service or product are specified in your booking confirmation and invoice. Unless otherwise stated, the following terms and conditions apply to each service or product:

  • Transportation: We provide or arrange transportation by car, bus, train, or plane, depending on the tour itinerary and availability. We use reputable and licensed transport providers, who are responsible for the safety and comfort of the passengers. We are not liable for any delays, cancellations, accidents, or damages that may occur during the transportation. You must comply with the rules and regulations of the transport provider and the authorities, and respect the rights and privacy of other passengers. You are responsible for your luggage and personal belongings, and we advise you to label them clearly and keep them with you at all times. We are not responsible for any loss, theft, or damage of your luggage or personal belongings.
  • Accommodation: We provide or arrange accommodation in hotels, riads, camps, or other establishments, depending on the tour itinerary and availability. We select the accommodation based on the quality, location, and availability of the facilities and services. We are not liable for any changes, cancellations, errors, or complaints that may arise from the accommodation. You must comply with the rules and regulations of the accommodation provider and the authorities, and respect the rights and privacy of other guests. You are responsible for any damages or charges that you may cause to the accommodation or its facilities and services. You must check in and check out at the specified times, and inform us or the accommodation provider of any issues or special requests.
  • Activities: We provide or arrange various activities for your tour, such as sightseeing, hiking, camel riding, or cooking classes, depending on the tour itinerary and availability. We use qualified and experienced guides, instructors, or operators, who are responsible for the safety and enjoyment of the participants. We are not liable for any injuries, accidents, or damages that may occur during the activities. You must comply with the rules and regulations of the activity provider and the authorities, and respect the rights and privacy of other participants. You must also ensure that you have the necessary skills, equipment, and insurance to participate in the activities. You must inform us or the activity provider of any medical conditions or special needs that may affect your participation. You may opt out of any activity at your own discretion and risk, but no refund or or compensation will be given.
  • Meals: We provide or arrange meals for your tour, such as breakfast, lunch, dinner, or snacks, depending on the tour itinerary and availability. We use reputable and hygienic food providers, who are responsible for the quality and quantity of the food. We are not liable for any allergies, illnesses, or complaints that may arise from the food. You must inform us of any dietary restrictions or preferences at the time of booking, and we will try to accommodate them as much as possible. However, we cannot guarantee that the food will meet your specific requirements or expectations. You may choose to eat at other places at your own expense and risk, but no refund or compensation will be given.

The price of your tour includes the services and products that are explicitly stated in your booking confirmation and invoice. The price does not include any other items that are not mentioned, such as:

  • Government taxes, fees, or levies
  • Supplementary insurance to our civil liability
  • Airport taxes, visa fees, or travel documents
  • Personal expenses, such as tips, laundry, phone calls, or souvenirs
  • Optional activities, services, or products that are not part of the tour itinerary
  • Meals or drinks that are not specified in the tour itinerary

You are responsible for paying for any additional or optional items that you may purchase or use during your tour, either to us or to the relevant provider.

Responsibilities and Liabilities

We are responsible for providing or arranging the services and products that are included in your tour, in accordance with these Terms and the applicable laws and regulations. We are also responsible for ensuring that our suppliers and partners comply with these Terms and the applicable laws and regulations. We will act in good faith and with due care and skill in performing our obligations under these Terms. However, we are not liable for any loss, damage, injury, illness, death, or inconvenience that you or anyone traveling with you may suffer or incur as a result of or in connection with your tour, except to the extent that such loss, damage, injury, illness, death, or inconvenience is caused by our negligence or willful misconduct, or that of our employees, agents, or suppliers.

Our liability to you is limited to the amount you paid for your tour, unless otherwise required by law. We are not liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, such as loss of profits, loss of data, loss of reputation, or loss of opportunity, arising out of or in relation to your tour, even if we have been advised of the possibility of such damages. We are also not liable for any damages that are caused by factors beyond our control, such as weather, natural disasters, civil unrest, war, terrorism, pandemic, or supplier failure. We are not liable for any damages that are caused by your own negligence, breach of these Terms, or violation of any laws or regulations. We are not liable for any damages that are caused by the negligence, breach of contract, or violation of any laws or regulations of any third-party providers, such as transport, accommodation, activity, or food providers, or any other parties involved in your tour. You agree to release, indemnify, and hold us harmless from any claims, demands, liabilities, costs, or expenses that may arise from or in relation to your tour, or your use of any services or products provided or arranged by us or our suppliers or partners.

You are responsible for your own actions and decisions during your tour, and for the consequences thereof. You are responsible for complying with these Terms and any applicable laws and regulations of the countries you visit. You are responsible for respecting the rights, privacy, and property of us, our suppliers, our partners, and other customers. You are responsible for ensuring your own safety and well-being, and that of anyone traveling with you, during your tour. You are responsible for obtaining and maintaining adequate travel insurance to cover any risks or losses that may occur during your tour, such as medical expenses, cancellation fees, or baggage loss or damage. You are responsible for informing us of any special needs or requests that you may have, such as dietary restrictions, medical conditions, or accessibility issues, at the time of booking, and for updating us of any changes before or during your tour. You are responsible for communicating with us and our suppliers and partners in a timely and courteous manner, and for providing us with accurate and complete information that we may need for your tour.

If you breach any of these Terms or any applicable laws or regulations, or if you cause any damage, injury, or inconvenience to us, our suppliers, our partners, or other customers, we may take any action that we deem appropriate, such as:

  • Canceling or terminating your booking or tour, without refund or compensation
  • Charging you for any costs or losses that we or our suppliers or partners may incur as a result of your breach
  • Reporting you to the relevant authorities or taking legal action against you
  • Banning you from booking or using our services or products in the future

Complaints

If you have any complaints or issues during your tour, you must bring them to our attention or the attention of our guide or representative as soon as possible, so that we can try to resolve them on the spot. If the complaint or issue cannot be resolved on the spot, you must notify us in writing within 15 days after the end of your tour, providing us with the details and evidence of your complaint or issue. We will investigate your complaint or issue and respond to you within 30 days after receiving your notice. We will try to resolve your complaint or issue in a fair and reasonable manner, and in accordance with these Terms and the applicable laws and regulations.

If you are not satisfied with our response or resolution, you may refer your complaint or issue to an independent third-party mediator or arbitrator, subject to our mutual agreement. The mediation or arbitration will be conducted in accordance with the rules and procedures of the chosen mediator or arbitrator, and the decision will be final and binding on both parties. The costs of the mediation or arbitration will be shared equally by both parties, unless otherwise agreed or awarded by the mediator or arbitrator.

If you do not follow the above procedure for complaints or issues, or if you do not notify us within the specified time limit, you will lose your right to make any claim or seek any compensation from us.

Governing Law and Jurisdiction

These Terms and any dispute or claim arising out of or in connection with them or their subject matter or formation (including non- contractual disputes or claims) shall be governed by and construed in accordance with the law of Morocco.

You and we irrevocably agree that the courts of Morocco shall have exclusive jurisdiction to settle any dispute or claim that arises out of or in connection with these Terms or their subject matter or formation (including non-contractual disputes or claims).

By booking a tour with Tour In Morocco, you acknowledge and accept these terms and conditions.
